Ryder Law of Spain

A pioneer in regulating platform work, Spain's Ryder Law established the presumption of employment for platform delivery workers and algorithmic transparency.

Following a landmark ruling by the Spanish Supreme Court in September 2020 recognizing the employment relationship between a delivery driver and the largest delivery platform in the country, the Spanish government established a social dialogue roundtable that brought together union representatives and companies, culminating in the enactment of the so-called Ryder Law (Law 12 of 2021).

The legislation made two changes to the Spanish Workers' Statute:

  • The first established that employee representatives "must be informed by the company of the parameters, rules, and instructions on which the algorithms or artificial intelligence systems" governing the activities provided are based.
  • The second introduced a new additional provision, the twenty-third, which states that there is a "presumption of employment within the scope of digital delivery platforms."
